7 Divorce Myths You Should Know – Bukhari Law Professional Corporation

Thinking of getting a divorce? Be aware of common myths:

  • Infidelity means fault in divorce: In no-fault divorce, courts don’t give special treatment to the “cheated” spouse. The divorce will proceed if legal grounds are met.

  • Short marriages mean no financial obligation: Even in short marriages, entitlement to support or property equalization can be established.

  • Spouse’s refusal stops the divorce: A divorce can still be granted even if one spouse refuses. The legal process allows it if grounds are met.

  • Pre-marital assets stay with the owner: Pre-marriage property may be excluded, but the increase in value during marriage can be considered.

  • Ownership means sole rights: Being on the title doesn’t guarantee sole possession, especially for the matrimonial home.

  • Leaving the home forfeits rights: Moving out doesn’t mean losing entitlement to equity or children.

  • No need to change the Will after marriage/divorce: Wills become void after marriage, but not after divorce. Update your Will to avoid unintentionally leaving assets to an ex-spouse.
